Terms of Service
These Terms of Service (“Terms”) constitute the terms under which the specific Services are offered by Raho and are to be read in consonance with the User Agreement. By booking any Service through the Platforms, you also agree to be bound by the Terms of the same, as may be applicable to you. You are therefore advised to carefully read and understand the Terms.
Any breach of the provisions contained in the Terms of Service shall be deemed to be a breach of the User Agreement.
Unless otherwise indicated, the capitalised words used in the Terms shall have the same meaning assigned to them in the User Agreement.
A. PROPERTIES
1. General
1.1. Each of the Properties listed on the Platforms may have specific terms and conditions associated with it. Therefore, you are advised to carefully read through the description and specifications mentioned under each of the listings prior to making any booking.
1.2. By booking any of the Properties, you agree to be bound by and follow all the terms and conditions in relation to such booking. By making a booking on behalf of another person, you warrant that you have informed such person about the terms and conditions concerning the Property, as well as the User Agreement, and these Terms.
1.3. The Platforms list such Properties which are owned by individuals or persons with whom Raho has a contractual relationship. Any independent action taken by the owners of the concerned Property shall be deemed to be beyond the scope of these Terms, which is not endorsed by Raho, and for which Raho shall not be held liable.
2. Your Responsibilities
2.1. You undertake to ensure that the primary guest at the Property shall be at least 18 years of age and be competent to complete the check-in formalities. You are responsible for complying with all applicable laws, rules, and directions issued from time to time by any appropriate governmental, statutory or regulatory authority that are in force in the jurisdiction where the Property is located.
2.2. You agree to provide accurate and complete contact information at the time of booking to enable us to provide you with the booking and Property information and intimate the concerned Property Manager about your booking.
2.3. You should possess and present valid proof of identity and address at the time of check-in.
2.4. You shall be responsible to take care of the Property, its furniture, fixtures, electronics, and other contents, and leave things in the same state they were when you first entered the Property. You may have access to the site in which the Property is located including the common areas. In the event of damage being caused to the Property, or its contents, or the surrounding common areas or if anything is lost due to your acts or omissions, or those sharing your booking ID, you shall be liable to make good such damage and/or loss to Raho or the owner of the Property, as the case may be.
2.5. The Property may be located in an ecologically sensitive area. You shall ensure that you and other the guests visiting the Property do not commit any act or omission that would disturb the ecological balance of the place where the Property is located.
2.6. House rules, if any, shall be applicable to you and you shall, apart from these Terms and User Agreement, abide by the house rules as applicable to the Property which is booked by you.
2.7. You are also responsible for promptly reporting any such damage or loss to the concerned Property Manager.
2.8. On-site Services:
(a) You may be able to avail on-site services during your stay at the Property including housekeeping, laundry, and such other services, subject to the location of the Property and availability of relevant service providers (“Service Providers”). You acknowledge that such Service Providers are independent and are not associated with Raho.
(b) You understand that Raho only facilitates the provision of such services, and shall not be responsible for the quality of the services.
(c) We request that you are courteous and respectful towards the Service Providers, and you provide them with appropriate access to perform their services. The services may be withheld, at our discretion, if you behave in a manner which is discourteous, disrespectful, abusive, or which we otherwise deem to be inappropriate or unlawful, towards the Service Providers.
(d) In the event a Service Provider behaves in a manner that is discourteous, disrespectful, abusive, inappropriate, or in violation of the law, you are required to report such incident to admin@raho.co.in at the earliest, but in any event, within 48 hours of such incident. Notwithstanding, Raho is not responsible or liabile for any acts or omissions of the Service Providers.
2.9. You will be solely responsible for ensuring the safety of all your personal possessions, including but not limited to electronic devices, wallets, jewelry, clothing, and vehicles (“Personal Possessions”). You are hereby advised to exercise diligence in safeguarding your Personal Possessions at all times, and make use of designated storage areas, if available, on the Property. In the event of loss or damage, you may contact the Property Manager for assistance. However, you understand and agree that Raho does not assume any responsibility for any loss and/or damage that may be caused to your personal possessions.
2.10. You further understand that Raho shall not be responsible or liable for any loss or damage during your stay at the Property that may be attributable to your negligence, unforeseeable events including any force majeure events, or events that are beyond your or Raho’s control.
B. EXPERIENCES
1. General
1.1. The definition of “Experiences” is as contained in the User Agreement. The providers of the Experience are referred to as “Service Agents”
2. Raho’s role and extent of liability
2.1. Raho only facilitates the booking of Experiences through its Platforms. The fulfilment and your participation in the Services takes place only between you and the concerned Service Agent.
2.2. While we endeavour to publish and display information, and the specific terms and conditions in relation to each of the Experiences, including any pictures of the same, as accurately as possible, the same are displayed only for reference purposes. We are not responsible for any variance that may exist between the pictures and/or information displayed on the Platforms and at the actual site of Experience. Any issues in relation to the same shall be raised directly with the Service Agent and be resolved between you and the Service Agent.
2.3. Raho does not provide any pick-up and drop facilities for any Experience unless otherwise expressly mentioned in your booking confirmation.
2.4. Raho shall not have any liability for any aspect of the arrangements between the Service Agent and you as regards the standards and rendering of services by the Service Agent in relation to the Experiences. In no event will Raho be liable for the services provided by the Service Agent.
2.5. Without limiting the generality of the foregoing, you understand and agree that Raho shall not be responsible for:
(a) any damage or loss, injury, accident, death, breakdown, irregularity, alteration in schedule, cancellations, inaccuracies in information, deficiency of service by the Service Agent;
(b) your health, safety and well-being during your participation in the Experience or thereafter;
(c) any incidental or ancillary services purchased by you directly from the Service Agent;
(d) any inaccuracies in the information supplied by the Service Agent.
2.6. In no event shall Raho’s maximum liability exceed the booking amount which was received by it in relation to the Experience.
3. Your Responsibilities
3.1. You agree to comply with the terms and conditions of the Service Agent, which shall be in addition to the User Agreement and the Terms.
3.2. You should present the booking confirmation issued by Raho at the time of participating in the Experience booked for.
3.3. You shall carry any documentation specified by the Service Agent in their terms and conditions.
3.4. You may be required to sign a waiver/consent form, medical declaration, or such other document as may be necessary for your participation in the Experience.
3.5. You acknowledge and agree that the Service Agent reserves the right to refuse your participation in any Experience if you do not meet the eligibility criteria necessary for the same.
C. TAXI BOOKING SERVICES
1. General
1.1. In order to enhance your stay at the Property, Raho may enable you to schedule taxi rides through the Platforms for travelling certain distance from the concerned Property (“Taxi Booking Services”). You may also be able to avail the Taxi Booking Services to reach the location of any Experiences which you have elected to participate in.
1.2. The Taxi Booking Services are charged and billed separately.
2. Raho’s Role and Extent of Liability
2.1. You understand that Raho does not own, operate , or function as an on-demand aggregator of any of the taxis, and that it only facilitates Taxi Booking Services through third-party taxi operators / owners / aggregators (“Operational Partners”).
2.2. You will be able to access the Taxi Booking Services on the Platforms only after Raho receives a booking confirmation in relation to a Property.
2.3. Raho is only responsible for enabling you to book a taxi ride through the Platforms by specifying your preferred time and destination for the ride.
2.4. Raho is not responsible for any subsequent actions that may be necessary for the fulfilment of your Taxi Booking Services, and the same shall be between you and the Operational Partners.
2.5. You understand and acknowledge that Raho does not monitor any of the taxi rides under the Taxi Booking Services through GPS/GPRS-based technologies,
2.6. The Operational Partners are solely responsible for obtaining and maintaining all the necessary licenses, approvals, authorisations, insurance, etc., for performing their services. We do not warrant the adequacy or validity of the licenses, approvals, insurance, and other authorisations which the Operational Partners may possess.
2.7. You understand that you are availing the Taxi Booking Services at your own risk, and Raho disclaims all representations and warranties, of any kind whatsoever, including (without limitation) with regard to the safety, timeliness, continuity, quality of the taxi rides scheduled through the Platforms, the conditions of the vehicle, driving skill, behaviour of the drivers, any act or omission of the drivers or Operational Partners and the consequences thereof.
2.8. The relevant Operational Partner shall be solely responsible for any and all liability or any damage caused to you or your property, resulting from, or alleged as a result of the operation of any of the vehicles in connection with these services.
2.9. While you may be able to report any dissatisfaction regarding the Taxi Booking Services to Raho, any disputes in connection with its fulfilment shall be independently pursued by you only against the relevant Operational Partner and/or driver.
3. Your Responsibilities:
3.1. You shall use the Taxi Booking Services only in your personal capacity, for tourism purposes. You are prohibited from using it for profit-making, commercial, unlawful, and/or illegal purposes.
3.2. You will be responsible for ensuring your safety, and the security of your personal belongings during any taxi ride.
3.3. You will further be responsible for meeting the driver at the scheduled time for pick-up, and you shall be courteous, respectful, and polite in your interactions with the driver and the Operational Partners.
3.4. You shall not:
(a) cause the driver to violate any traffic rules or other applicable laws;
(b) unilaterally modify the route and/or the destination of the taxi ride; or
(c) board any taxi whilst under the influence of any drug or similar intoxicating substance.
3.5. Your taxi ride may be subject to additional terms and conditions which the relevant Operational Partner may communicate to you. Raho has no involvement in stipulating the same, and shall not be liable for any cancellation of your taxi ride in accordance with such terms and conditions.
D. ADD-ON SERVICES
1. General
1.1. You may be able to avail certain additional products and services such as food and wine, shopping for chocolates and spices, etc. (“Add-On Services”). The Add-On Services are billed and charged separately.
1.2. You will be able to access the Add-On Services through the Platforms after we receive your booking confirmation. The availability of the Add-On Services may vary depending on the location of the Property booked by you.
2. Raho’s Role and Extent of Liability
2.1. You understand that Raho only facilitates the booking of Add-On Services through its Platform and shall not be responsible for the fulfilment or quality of the same, or for any damage that may be caused due to the consumption of the Add-On Services.
2.2. The description and other information available on the Platforms relating to any Add-On Services are provided to us by the providers of such services. While we require for the providers of Add-On Services to include only accurate information, we will not be responsible for any variance or discrepancies between the same and the actual product or service received by you.
2.3. Raho does not guarantee the prompt delivery of the Add-On Services, or its suitability for your consumption.
3. Your Responsibilities
3.1. As a consumer of the Add-On Services, you are responsible for checking the descriptions of the services which you intend to avail, prior to placing any order.
